  18. Product, but only a right of limited use as outlined in this license
  19. agreement. MEGALUX hereby grant you a non-exclusive, royalty free
  20. license to use the Software.

  22. RESTRICTIONS

  24. Without the expressed, written consent of MEGALUX, you may NOT rent or
  25. lease the Software, or sell any portion of the Software.
  26. If you intend to use this software in connection with operation of
  27. scoreboards or advertisement boards or any other electric advertisement
  28. media (Internet excluded) you must contact MEGALUX to get a written
  29. permission.

  31. LIMITED WARRANTY

  33. THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF
  34. ANY KIND EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT

  71. END-USER LICENSE AGREEMENT FOR ADSOFTWARE

  73. IMPORTANT-READ CAREFULLY
  74. This License Agreement is a legal agreement between you (either
  75. an individual or a single entity) and Aureate Media Corporation
  76. ("Aureate Media") for use of the AdSoftware System, which
  77. includes computer software and may include associated media,
  78. printed materials, and "online" or electronic documentation
  79. ("SOFTWARE PRODUCT, this software"). "SOFTWARE PRODUCT" also
  80. includes, and this Agreement also governs, any later release or
  81. update of the AdSoftware System which Aureate Media makes
  82. generally available without additional charge of licenses or
  83. your release or the SOFTWARE PRODUCT, and any copy of the
  84. SOFTWARE PRODUCT made in accordance with this Agreement. By
  85. downloading, installing, copying, or otherwise using the
  86. SOFTWARE PRODUCT, you agree to be bound by the terms of this
  87. License Agreement. IF YOU DO NOT AGREE TO THE TERMS OF THIS
  88. LINCENSE AGREEMENT, ABORT THE INSTALLATION AND REMOVE THIS
  89. AND RELATED SOFTWARE FROM YOUR COMPUTER SYSTEM IMMEDIATELY.

  91. The SOFTWARE PRODUCT is protected by copyright laws and
  92. international copyright treaties, as well as other intellectual
  93. property laws and treaties.

  95. This SOFTWARE PRODUCT is "advertiser supported software,"
  96. meaning that some or all of the costs associated with the
  97. development and distribution of this SOFTWARE PRODUCT is
  98. recuperated through the use of advertisements displayed in the
  99. software product. These advertisements are delivered via the
  100. Internet and will be downloaded from the servers of Aureate
  101. Media or their subcontractors, partners, or other authorized
  102. parties. By using this software, you agree that you understand
  103. that this software will connect to the Internet UBIQUITOUSLY to
  104. download advertisement and/or to provide software updates. You
  105. also accept responsibility for any network usage costs or any
  106. other costs incurred by using this software.

  108. All title and copyrights in and to the SOFTWARE PRODUCT
  109. (including but not limited to any images, documentation, media,
  110. online documentation, text, and "web integration" incorporated
  111. into the SOFTWARE PRODUCT), the accompanying printed materials,
  112. and any copies of the SOFTWARE PRODUCT are owned by Aureate
  113. Media or its authorized agents. As a licensee, you own the
  114. media on which the SOFTWARE PRODUCT is recorded, but Aureate
  115. Media and all Third Party Suppliers retain title and ownership
  116. to the SOFTWARE PRODUCT recorded on the media and all copyright
  117. and other ntellectual property rights therein. This license is
  118. not sale of the software or any copy. Except as may be required
  119. under applicable law, you agree not to alter, decompile,
  120. disassemble, or reverse engineer the SOFTWARE PRODUCT, in whole
  121. or in part, whether for error correction or otherwise. The
  122. SOFTWARE PRODUCT is protected by copyright laws and
  123. international treaty provisions.

  125. You agree not to alter, remove or obscure any copyright notices
  126. or other proprietary notices on and in the software.

  128. LIMITED WARRANTY
  129. NO WARRANTIES.  - Aureate Media  EXPRESSLY DISCLAIMS ANY
  130. WARRANTY for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT
  131. and any related documentation is provided "as is" without
  132. warranty of any kind, either express or implied, including,
  133. without limitation, the implied warranties or merchantability,
  134. fitness for a particular purpose, or noninfringement. The
  135. entire risk arising out of use or performance of the SOFTWARE
  136. PRODUCT remains with you.

  138. NO LIABILITY FOR DAMAGES. In no event shall Aureate Media or
  139. its suppliers be liable for any damages whatsoever (including,
  140. without limitation, damages for loss of business profits,
  141. business interruption, loss of business information, or any
  142. other pecuniary loss) arising out of the use of or inability to
  143. use this SOFTWARE PRODUCT, EVEN IF AUREATE MEDIA HAS BEEN
  144. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
